17 Aug 2012

You are invited to comment on the exposure draft of the Intellectual Property Laws Amendment Bill 2012. Submissions are due by 1 October 2012.

The TRIPS Protocol helps developing nations tackle health epidemics. Diseases such as malaria and HIV/AIDS can be managed with affordable generic medicines from other countries. But how should Australia implement the protocol?

In 2010, the public were invited to comment on an implementation proposal. Since then, IP Australia revised the proposal and developed an exposure draft bill.

In addition to addressing the TRIPS Protocol, the draft bill amends plant breeder’s rights (PBR). PBR owners can prosecute infringers in the Federal Magistrates Court as a quicker, simpler alternative to the Federal Court.

More information and access to the exposure draft is available on the TRIPS Protocol.
