Public Consultation for Raising the Bar Regulations

The public is invited to comment on draft regulations that provide the important detail of reforms under the Intellectual Property Laws Amendment (Raising the Bar) Act 2012. The Act was passed by Parliament in March this year.

The regulations will be of particular interest to the attorney profession, inventors, brand owners and the broader innovation community. It is important for all interested stakeholders to provide their input.  This will make for a smooth transition when the new legislation takes full effect on 15 April 2013.

The draft regulations will be published in two stages to maximise the time for public comment. Today's release covers:

  • Schedule 1 - Raising the quality of granted patents,
  • Schedule 4 - Assisting the operations of the IP profession, and 
  • Schedule 5 - Improving mechanisms for trade mark and copyright enforcement.

Draft regulations for Schedules 3 and 6 will be available shortly. (Schedule 2 relates to provisions which are already in force and require no regulations). Public consultation for all schedules will be completed by 21 November 2012.
