Disruption to WIPO services

WIPO has advised of a temporary disruption to some of their services.

Due to a temporary disruption to WIPO services, WIPO services will be unavailable until Monday 31 October 2011 CEST.

For the purposes of WIPO's registration services, (PCT, Madrid System, Hague System, Arbitration and Mediation Center), WIPO is closed for business on October 27 and 28.

This currently affects access to WIPO's website and as a result, IP Australia's International Fee Calculator for trade marks.

International Trade Mark Applications can still be submitted to IP Australia with the required $100 Handling Fee. Applicants will be advised of any further fees required in due course.

In regard to PCT applications, the following Article 11 provisions apply. Copies of WIPO-PCT forms are available from IP Australia.  Please contact us during business hours.

Article 11

Filing Date and Effects of the International Applications

 

(1)    The Receiving Office shall accord as the international filing date the date of receipt of the international application, provided that that Office has found that, at the time of receipt:

(i)                  the applicant does not obviously lack, for reasons of residence or nationality, the right to file an international application with the receiving Office,

(ii)                the international application is in the prescribed language,

(iii)              the international application contains at least the following elements:

(a)    an indication that it is intended as an international application,

(b)    the designation of at least one ContractingState ,

(c)    the name of the applicant, as prescribed,

(d)   a part which on the face of it appears to be a description,

(e) a part which on the face of it appears to be a claim or claims
