IP Reform – Publication of Changes to the Patent Manual of Practice and Procedure

The provisions of the Intellectual Property Laws Amendment (Raising the Bar) Act 2012 will commence on 15 April 2013. Publication of changes to the Patent Manual of Practice & Procedure (the Manual) relating to IP reform will occur in stages leading up to the commencement date. Changes to Volume 2 of the Manual were published on 1 February 2013. Publication of further changes to the Manual is expected to occur on 1 March 2013, 2 April 2013 and 15 April 2013.

The practices relating to IP reform can be identified within the Manual by notes at the start of each part. Where examination practice varies pre- and post-commencement, there are alternative parts of the Manual labelled using the format 2.12.1 and 2.12.1A, where 'A' indicates that the practice applies post-commencement. Please note that the new examination practices will not come into effect until 15 April 2013.
