PBRAC recent meeting summaries

51st Meeting of the Plant Breeder's Rights Advisory Committee (PBRAC)

The 51st meeting of the Plant Breeder's Rights Advisory Committee (the Committee) was held in Canberra on 14 November 2013.  This was the first meeting of the newly appointed Committee with one reappointed member, Mr Chris Prescott.  Mr Nik Hulse from IP Australia chaired the meeting. Go to the PBRAC Committee Members page to view the committee members.

After a photograph of the Committee taken outside IP Australia, the Committee was given an introduction to the role and responsibilities of the Committee by the acting chair.

The Committee received presentations from Sue Welin, Director Corporate Communications, IP Australia, and Jeff Carl, ACIP Secretariat, also of IP Australia.  The presentations focused on education and awareness issues relating to Plant Breeder's Rights.
The Committee considered the possibility of exploring the topics of end point royalties and a notification scheme (similar to that available in the United Kingdom).  It is anticipated that these topics will form the Committee's work plan for the next year.

The next PBRAC meeting is scheduled for 1 May 2014 in Canberra.

50th Meeting of the Plant Breeder's Rights Advisory Committee (PBRAC)

The 50th meeting of the Plant Breeder's Rights Advisory Committee (the Committee) was held in Canberra on 17 October 2012.

This was the final meeting of the current Committee and also the 50th meeting of the PBRAC. The Committee met with representatives of the Trade Marks' Consultation Group to discuss issues associated with use of both the PBR and Trade Marks systems. The Committee also discussed the development of a plan for communicating the value of the PBR system to the broader community.   

The Committee was also updated on:

  • progress with implementing the IP Laws Amendment (Raising the Bar) Act 2012
  • progress with implementing the Government Response to the PBR Enforcement Report
  • the Australia/New Zealand Single Economic Market initiative for IP rights
  • international activities, including the recent UPOV General Assembly

The next meeting of the PBRAC is scheduled for Wednesday 17 April 2013, in Canberra.

49th Meeting of the Plant Breeder's Rights Advisory Committee (PBRAC)

The 49th meeting of the Plant Breeder's Rights Advisory Committee (the Committee) was held in Canberra on 18 April 2012.

The Committee received presentations on the launch of IP Australia's eServices portal and an update on the grain industry's end point royalty process and licensing agreements operating in Australia. The Committee also discussed the implementation of IP Australia's fee changes, which are scheduled to come into effect from 1 July 2012.

The Committee was also updated on:

  • progress with implementing the IP Laws Amendment (Raising the Bar) Act 2012
  • progress with implementing the Government Response to the PBR Enforcement Report
  • the Australia/New Zealand Single Economic Market initiative for IP rights
  • international activities, including the recent UPOV General Assembly

The next meeting of the PBRAC is scheduled for Wednesday 17 October 2012, in Canberra.

48th Meeting of the Plant Breeder's Rights Advisory Committee (PBRAC)

The 48th meeting of the Plant Breeder's Rights Advisory Committee (the Committee) was held in Canberra on 12 October 2011.

The Committee completed its review of Plant Breeder's Rights fees which will inform the IP Australia fee review planned for 2012. The Committee recommended that PBR fees be increased to achieve cost recovery, using a phased approach.

The Committee was also updated on:

  • the government response to the ACIP Plant Breeder's Rights Enforcement report
  • progress with the Australia/New Zealand Single Economic Market initiative
  • international activities including the recent UPOV General Assembly

The Committee also continued its discussion on the grain industry's end point royalty process and licensing agreements operating in Australia.

The next meeting of the PBRAC is scheduled for Wednesday 18 April 2012, in Canberra.

47th Meeting of the Plant Breeder's Rights Advisory Committee (PBRAC)

The 47th meeting of the Plant Breeder's Rights Advisory Committee (the Committee) was held in Canberra on 13 April 2011.

The Committee discussed issues associated with its review of Plant Breeder's Rights fees. This review will make recommendations for changes that will inform the broader IP Australia review of all its fees planned for 2012.

The Committee was also updated on the new Privacy and Freedom of Information regime and what that means for the way information held by the government is managed and accessed by members of the public.

PBRAC member, Mr Kerry Gleeson, provided a very informative presentation on the grain industry's end point royalty process and licensing agreements that are successfully operating in Australia.

The Committee was also updated on:

  • progress with the government response to the ACIP Plant Breeder's Rights Enforcement report
  • the Australia/New Zealand Single Economic Market initiative
  • international activities including the recent UPOV General Assembly

46th Meeting of the Plant Breeder's Rights Advisory Committee (PBRAC)

The 46th meeting of the Plant Breeder's Rights Advisory Committee (the Committee) was held in Canberra on 13 October 2010.

The Committee noted that it would now be advising and reporting directly to the Minister for Innovation, Industry, Science and Research, Senator Kim Carr.

The Committee discussed the recommendations of the Advisory Council on Intellectual Property (ACIP) Review of Enforcement of Plant Breeder's Rights. The Committee also noted that the finalisation of the Government's response to the ACIP Review is scheduled to coincide with its response to a second ACIP Review on Post Grant Patent Enforcement.

This was the first meeting for Professor Robert Henry who gave a brief outline on his role as Professor of Innovation in Agriculture at the University of Queensland and also as Director of the Queensland Alliance for Agriculture and Food Innovation.

There was some informative discussion about the success of end point royalty process and licensing agreements that are operating in Australia.

The Committee was also updated on:

  • The new Australia/New Zealand Single Economic Market initiative
  • International activities including the UPOV General Assembly and the Technical Working Party for Agricultural Crops

The Committee also discussed the Registrar's request to contribute to IP Australia's review of PBR Fees.

45th Meeting of the Plant Breeder's Rights Advisory Committee (PBRAC)

The 45th meeting of the Plant Breeder's Rights Advisory Committee was held in Canberra on 14 April 2010.

As the 45th meeting was the first session of the newly appointed Committee, many of the agenda items focussed on providing background for the new members, including its statutory role in advising the Minister on issues that may arise under the Plant Breeder's Rights Act 1994.

The Committee was also updated on:

  • proposed IP outcomes under the Australia/New Zealand Single Economic Market (SEM) Framework, including the single trans-Tasman plant variety rights regime
  • recent legislative changes to the Plant Breeder's Rights Act 1994 and the Personal Property Securities Act 2009
  • international activities associated with the International Union for the Protection of New Varieties of Plants (UPOV); the East Asia Plant Variety Protection Forum; and the 2nd World Seed Conference

The Committee also discussed the final report of the Advisory Council on Intellectual Property (ACIP) on the Review of Enforcement of Plant Breeder's Rights.

The Committee's next meeting is scheduled for 13 October 2010 in Canberra.
