Continue under the old Act

You can no longer make an application under the previous Designs Act 1906.

However, if you applied to register your design before Thursday 17 June 2004, you can choose whether you want to continue under the old Act, or convert your application to the new Act.

Unless you request conversion of your application, we will continue to examine it under the old Act.

Please note that a design registered under the old Act cannot be examined under the new Act.

Registered designs under the old Act will remain as they are, with old Act:

  • Term (16 years);
  • Renewal periods;
  • Fees; and
  • Validity and infringement provisions.
