Convert to the new Act

If you applied to register your design before Thursday 17 June 2004, you can choose whether you want to continue under the old Act, or convert your application to the new Act.

If you choose to convert, you need to request conversion to the new Act - if you don't we will continue to examine your old Act application under the old Act.

There is no fee for converting to the new Act.

You must make your conversion request before the old Act application is registered, or lapses, is refused or is withdrawn.

A converted application will be an application under the new Act, but it will:
• Retain its filing date;
• Retain its priority date;
• Be taken to have met minimum filing requirements;
• Be taken to be a request for all designs in the application;
• Have a new Act term (10 years) starting from the date of conversion request; and
• Have the new Act validity and infringement provisions.
