The examination and certification process

Under the Designs Act 2003 registered designs are not automatically examined. To fully enforce your rights to your design in the marketplace, your registered design must be certified following an examination.

To request an examination, you must complete a Request for Examination form, and pay the required fee. We will then check that your Registered Design meets all relevant requirements of the Designs Act 2003.

Another person can also request examination of your registered design. They would fill in the same form, and pay half the required examination fee. You must pay the other half of the fee, as, if your design is certified, you would receive the benefits. If someone else requests examination of your registered design, and you do not pay the balance of the examination fee, your registration will cease.

What happens after examination?
Once your registered design has been examined, you will receive one of two possible replies, either:
• a notice that your registered design has been successfully certified; or
• an adverse report.

If your registered design is certified, your rights are fully enforceable and we will republish your design as certified in the Official Journal.
If you receive an adverse report, it will explain why your registered design does not meet the requirements of the Designs Act. You will have the opportunity to reply to this and/or amend the details of your registration to a limited extent.
