Managing your design is important for making sure you gain the most benefit from your IP assets.

Enforcing your rights

If your registered design is infringed, or you believe it is being infringed, you should consider requesting an examination immediately. 

You can only enforce your rights to your design once your registered design has been examined and issued a certificate of examination.  You may also wish to seek legal advice.

If your registered design is examined and issued a certificate of examination, you can then take legal action against the competing party. However, if it is examined and found invalid, your design registration will be ceased or revoked and you will not be able to take any action.
