Filing your application online
Applications for plant breeder's rights (Part 1 only) can be made online.
Application Part 1
In Part 1 of your application, you provide your details, information about the origin of the variety and an initial case for eligibility. If the variety is already commercialised in Australia or overseas, then time limits apply (refer to Sale information). If Part 1 of your application is not received before the expiry of the eligible prior sales period, your plant variety will not be eligible for protection.
You can apply online for your part 1 PBR application.
Application Part 2
Part 2 of your application provides evidence in support of the claims made in the first part of your application and a detailed description of the variety, specifying differences from other similar varieties.
The purpose of the Part 2 Application form is to present the results of the comparative growing trial in particular to present evidence of distinctness, uniformity and stability.
