The TM Headstart service is for those customers who already have a trade mark in mind and have gathered enough information to submit a request. The service will not help you to choose or develop a trade mark and cannot provide legal or business advice in relation to:

  • strategies for protecting the trade mark and enforcing protection
  • whether you will be infringing another trader's common law rights - you should conduct searches before deciding on your trade mark including ATMOSS (Australian Trade Mark Online Search System)
  • how your business can make the best strategic use of a trade mark
  • whether the goods and/or services for which you seek protection give you optimum coverage for your business

Important note: your date of protection

Should your trade mark proceed to registration, the protection given by registration is taken from the date you completed the filing process, not the date you submitted your request. The filing process is complete when you have paid the Part 2 fee.

If obtaining the earliest possible protection is important to you, then you should consider filing an application as soon as possible through the standard trade mark application process.
