Designs Office Manual of Practice and Procedure

The Designs Office Manual of Practice and Procedure is a reference tool for designs examiners and support staff within IP Australia. It sets out procedural and legal matters relevant to the examination of design applications under the Designs Act. The manual is not a user guide for designs applicants.

Australian Designs Office Manual of Practice and Procedure (2003 Act)

The Designs Office Manual of Practice and Procedure (2003 Act) will continue to evolve in line with the development of decided cases, hearing decisions and changes in practice. Material is presently available on formalities in Part 1, and the content in Part 2 includes searching, examination and some other practices.

Under the 2003 Act examination only occurs after registration of a design and only on request of the registered owner or a third party.

The 2003 Act applies where the design application was filed on or after the commencement of the Designs Act 2003 on 17 June 2004 or was filed before that date and later converted to an application under the 2003 Act.
