The following official notice will be published in the Australian Official
Journal of Patents on May 20.
In May 2004 amendments were made to the Manual of Practice and Procedure Volume
1 - International.
The changes relate to:
- Updating the practice for ISO's, such that the same mailing date
for an ISR must be used on the ISO (paras 1.11.37, 3.5.1.2)
- Stipulating that the second sheet (Box I) of an ISO ("Basis
of the Opinion") should always be included in the opinion. (para 3.5.2.1)
- Clarifying the reason for including NPL "P,X" documents
in IPER/IPRPII's (paras 3.5.6.1, 3.5.7.1)
- Making explicit the fact that Abstracts cannot be amended under Article
34 and are not to be annexed to IPER/IPRPII's (para 3.5.2.4)
- Updating GCC examination procedures (paras 4.4.1-4.4.10 (cont))
- Updating Singapore Search and Examination procedures as a result
of a general review (paras 4.5.1-4.5.71)
- Replacement of WIPO's provisional PCT International Search and Preliminary
Examination Guidelines of 1 January 2004 with the 25 March 2004 formally promulgated
version (Part 5)

IP Australia wishes to announce that we are now providing the added option of e- mail for delivery of Patent
Specifications. Our current methods of fax and mail delivery are still available as a customer option.

Consideration of patents and experimental use
27 February 2004
The Commonwealth Government recently asked the Advisory Council on Intellectual Property (ACIP) to examine whether some types of patents are inhibiting research and development in Australia and determine whether both Australian researchers and business would benefit from introducing an experimental use exception provision (or some other provision) into the Australian patent legislation. In examining this question, ACIP should consider whether an experimental use exemption would help researchers more effectively use the patent system to commercialise their research and development.
ACIP has just released a discussion paper and would welcome comments on the
issues raised. Comments should be received by no later than 30 April 2004.

In January 2004 amendments were made to the Manual of Practice and Procedure
Volume 1 - International.
The changes, beginning 1 January 2004, relate to:
- Revision of Australian PCT search and Examination procedures to bring our practice
into agreement with new WIPO procedures (Parts 1 and 3)
- Revision of PCT Search Refund Guidelines (Part 1 Annex S)
- Inclusion of WIPO's new PCT International Search and Preliminary Examination
Guidelines (Part 5)
- Inclusion of amendments to the PCT Administrative Instructions (Part 9)
