Trade Marks  

Who can apply?

A person who claims to be the owner of a trade mark can apply for registration of that trade mark. The applicant must have legal personality, and may be an individual, a company, an incorporated association or a combination of these. A trading or business name is not acceptable as the owner’s name. In such a case the person or people who own the business should apply. If more than one person owns a trade mark, they may jointly apply to register that trade mark. If there is more than one applicant then all names should be given.

You must use, or intend to use, the trade mark in relation to the goods or services included in the application.

If the trade mark is to be used by a body corporate about to be formed, the applicant will need to assign the trade mark to the new body.
