Accessing the trade marks mainframe database
The Mainframe facility contains several different
searches each of which is briefly described below.

1. CPI Search Facility
A complex search of constituent particulars of trade marks (ie. how the trade
mark is described) which includes full word, part word, prefix, suffix, phonetic
and device constituent searching.
2. Display Selected CPI Records
Displays the constituent particulars index of a trade mark.
3. Search for Australian Surname
This is a search of surnames supplied by the Australian Electoral Office. It
gives an indication of whether a trade mark is a common surname (and so not
capable of distinguishing under the Trade Marks Act 1995). Note: common = 500
or more occurrences.
4. Search for Pharmaceutical Name
This search is based on the list of international non-proprietary names for
drugs supplied by the World Health Organisation. Registration of these non-proprietary
names is prohibited. It is recommended that this search be carried out on application
relating to pharmaceutical goods or services (ie. in classes 1, 3, 5, 10, 35,
41 & 42).
5. Search Classification Data on Goods and Services
Goods and Services are classified according to the International (Nice) Classification
of Goods and Services for the Purposes of the Registration of Marks. This classification
system sees goods divided into 34 classes and services into 8 classes, a total
of 42 classes. This search facility allows you to determine in which of the
42 classes a particular item may be found. Note that the Office regularly adds
items to this listing and these may be searched separately under Office Determinations.
6. Search Classification Data by Class
Displays the items found in each of the 42 classes. Additionally each class
listing provides a brief description of the nature of the items to be found
therein.
7. Enquiry Facility - Application/Registration Details
This facility allows you to view the details of one or more trade marks. To
view the details enter a single number, a range of numbers or a list of up to
5 numbers in the fields on the in the Trade Mark Number Enquiry screen and then
press enter. (Note: You may perform a more complex enquiry using criteria such
as owner name and status by entering Y in the first field. More detailed
help on the use of this facility can be found in the Trade
Marks Online Search Manual)

The following screen shows a summary of the main details of the trade mark,
eg number, filing date, status, owner name, class and some details of the trade
mark itself. (Note that if more than 20 records are being viewed, summary entries
will be listed 4 to a page. Entering S or X alongside these entries will display
the full trade mark abstract).

The goods and/or services can be viewed from the abstract screen (shown above)
in two different ways. If you want to look at whatever goods/services the owner
has claimed, you can simply press F9 to display the first class of goods
or services. To return to the abstract or display the next class press Enter.
You can also select the required class/es by placing and S or X in the field
next to the class number. This method will allow you to view one or more of
the classes of a multiclass application.

With the abstract displayed, press F1 to list further options. The list
tells you the options available for the record currently being viewed. eg: Owner
Name and Address - For the name and address, enter Option 2 (TM Record Owner
Details) in the option field and press enter. If you want to return to the main
application abstract or summary, just press enter again.
History details - Enter Option 3 and enter. If there is more than one page
of details use F8 to go forward. Enter will take you back to the abstract
screen.

When can I use the database?
Our databases are not available on Wednesday evenings
between 8 pm-12 pm and from Friday 9 pm to Saturday 9 am (Australian EST), when
regular development and maintenance is undertaken.
Training is available in Australian capital cities on a regular basis.
