Make it Happen!

Before you start

Make sure you've read the background information about TM Headstart on IP Australia's main website.

For speed, you'll need:

  • Your name, address and contact details for the form.
  • Your trade mark. If it is an image it must be in GIFF (.gif), TIFF (.tif), BMP (.bmp), JPEG (.jpg or .jpeg), or PNG (.png). The minimum image size is 227 x 227 pixels (approximately 8cm x 8cm). File attachments are limited to a maximum of 10Mb.
  • To know what you are offering as goods or services.
  • Your credit card details handy (MasterCard, VISA or Amex only).

Important technical details

  • You must have cookies enabled on your computer or the e-form may not work properly. Your computer's cache must also be set to refresh each page, every time you view it.
  • Your browser must have JavaScript enabled.
  • A screen resolution of at least 1024 x 768 is recommended.
  • The logon session will time out after one hour of inactivity to protect your privacy, but if you are using dial-up your internet provider may disconnect you before this.

Terms and Conditions

IP Australia and TM Headstart cannot:

  • Provide legal advice.
  • Check if you are infringing on another trader's common law rights.
  • Tell you how your business can make the best strategic use of your trade mark.
  • Tell you whether the goods and services you have selected give the best coverage for your business.
  • Provide you with strategies for protecting your trade mark and enforcing protection.

If you need this kind of advice you should speak to a registered trade marks attorney or IP professional.

Additionally, IP Australia and TM Headstart cannot:

  • Refund your TM Headstart entry fee if your request is unsuccessful or if the Part 2 fee is not paid by 11.59pm (Canberra time) on the discontinuation date.
  • Refund your Part 2 fee if a similar trade mark is found in the top-up search or at a later date.

There are some trade marks that are excluded from TM Headstart. These can only be submitted through a standard trade mark application. They are:

  • special kinds of signs / non-traditional trade marks
  • series trade marks
  • certification trade marks
  • defensive trade marks
  • divisional applications.
