Business Name Search Service
Make sure your proposed business name is not somebody's trade mark.
Be aware that registering your business name does not give you ownership of that name. That's why we offer a service to help you get your business name right the first time around.
Choosing a business name that infringes an existing trade mark can be a costly exercise - it could mean hefty legal bills, drawn out disputes and even the closure of your business.

Other Assistance Available
TM Check is an easy to use search tool designed for Business Name applicants to identify pending and registered trade marks which may be similar or identical to their proposed business name.
As a simplified search it does carry some risks - be aware that a search using TM Check will return a maximum of 10 results, even if there are more trade marks that match your search criteria.
We strongly suggest that you compare the results obtained through TM Check against those delivered through IP Australia's existing trade marks search system, ATMOSS.
Professional searches are also available from patent and trade mark attorneys, legal practitioners and search firms.
Contact us to find out more about why you should carry out a trade mark search.
Note: The search service will locate only those registered or pending trade marks that are identical or very similar to your proposed business name. Only those trade marks actually registered or pending (subject to indexing) on the day of the search will be considered. We accept no responsibility for matters resulting from our reporting.
