Issue summary

The PBR Act specifies the Registrar must give public notice of surrender due to the applicant failing to pay the prescribed fee.

However, in the case of a voluntary surrender there are equivalent provisions requiring the Registrar to give public notice, however, while it is the Plant Breeders Right Office practice to publish such a notification, specifying this in the legislation will ensure consistency and that the public is aware of the surrender of a grant as soon as practicable.
