Plant breeder’s rights (PBR) records

Purpose

 

Enable IP Australia to meet its accountability requirements to the Australian Government by providing an effective history of transactions and decisions made under the Plant Breeder’s Rights Act 1994. The records provide details of the administration of PBR applications and registered PBRs.

 

Content

 

All information associated with the prosecution of PBR applications and the maintenance of granted PBRs. Includes applicant details and plant variety descriptions.

 

Access and Security

 

Access to PBR records depend on the type of record. Most PBR records are unclassified and can be accessed via freedom of information requests, except for:

•           Financial information provided ‘in-confidence’ by applicants – treated as For Official Use Only.

•           Legal advice requested by IP Australia or provided by an applicant to support their application – treated as Sensitive: Legal

•           Particulars of each parent variety used in the breeding of the plant subject to the PBR application – treated as Sensitive
