Patents, trade marks, designs, plant breeder’s rights, copyright and circuit layouts are all identified as personal property that is the subject of a security interest.
Personal Property Securities Register
The Personal Property Securities Register (PPSR) is a central Australian register for the registration of security interests in personal property other than land and fixtures.
Personal property includes intellectual property (IP), as well as IP licences.
Searching the PPSR
Before purchasing the rights to IP, you should check there are no existing security interests by searching the PPSR. You should also search if you are taking security over any IP as part of a financing arrangement, or taking security over a licence to use or exploit the IP.
