Madrid fee process change

From 1 July, IP Australia will stop collecting and forwarding Madrid Export fees under Rule 34(2) of the Common Regulations under the Madrid Agreement and stop accepting select forms on behalf of WIPO. Customers will instead pay and file directly to the International Bureau through their portal, enabling them to interact directly with the office administering their request.

In paying directly to the International Bureau customers can be assured the correct fee has been paid based on the exchange rate at the time.

The list of forms which now need to be lodged directly with WIPO are listed below. Please note this does not change the process for filing new export applications through the Madrid e-filing system currently available through IP Australia’s e-services.

Forms that customers will lodge directly with WIPO to the email address on the front page of the correspondence:

MM4 – Designation subsequent to the international registration and the filing fees

MM5 - Request for the recordal of a Change in Ownership and the filing fees

MM6 – Request for the recordal of a Limitation of the List of Goods and Services and the filing fees

MM7 – Request for the recordal of a Renunciation

MM8 – Request for the recordal of a Cancellation of the International Registration

MM9 – Request for the recordal of a Change in Name and/or Address of the Holder and filing fees

MM10 – Request for the recordal of a Change in Name and/or Address of the Representative

MM11 – Renewal of the international registration and fees

MM12 – Appointment of a representative

MM18 – Declaration of intention to use in the mark (United States of America)
