Under the Trade Marks Act 1995, if an application complies with the requirements for filing the Registrar must publish the particulars of the application in accordance with the regulations.
Particulars of an application are considered published when the details of the application are available in the trade marks database (ATMOSS) which means the application fee is no longer refundable and the application can no longer be amended under the provisions of s64.

With the introduction of eServices the time between filing and publishing of a new Trade Mark application has been significantly shortened, in that the particulars of an application are published on the same day as filed or within one business day.
