Chloe would like to register a trade mark for her legal firm.

Chloe is unsure whether she should include a claim for advertising services in Class 35, as she advertises her business online, through her social media channels and printed flyers.

A claim for advertising services, however, is a claim for providing advertising for others as a service.

Chloe’s legal firm does not advertise for other businesses.

With that in mind, this is probably not the correct claim for Chloe.

She is providing legal services, which are in Class 45, and not advertising services.

Before claiming services, ask yourself, ‘do I provide these services for other businesses?’

You can still advertise your legal service as that is normal practice when running a business.
