Consideration of a position on the patenting of business systems

Review commenced: 01/07/2002
Duration of review: 2002-2005

In the late 1990s - early 2000s there was a rapid increase in the patenting of business systems such as e-commerce models. This increased patenting activity raised issues regarding patentable subject matter and the impacts that these patents have on business.

ACIP released an Issues Paper in July 2002 to seek the views of interested parties and public forums were held in late 2002. The Australian Government released ACIP's Final Report on 25 February 2004 and the Government response was released on 26 May 2005. Responding to these concerns, the Australian Government asked ACIP to undertake an examination of what approach Australia should take on the patenting of business systems.
