I have been a Nationally Accredited Mediator since 2008 holding registrations both with the Resolution Institute and the Queensland Law Society.
I have conducted mediations as a mediator for the Office of Franchising Mediation Adviser since 2014 as part of that office's national panel of mediators in Queensland and Victoria.
I also accept appointments to conduct private mediations as a mediator both prior to and during court processes at the request of parties in disputes and have done so since 2008.
To date I have conducted mediations as a mediator for unrepresented parties, legally represented parties and group mediations. Generally these mediations are in person however I also make use of technology such as teleconferencing, skype and video conferencing where necessary and where facilities are available to mediate disputes.
Prior to gaining my accreditation as a mediator I also represented as an advocate parties in mediation and continue to do so where requested.
I am an Australian Legal Practitioner of in excess of 16 years private practice in Queensland and Victoria and am an Accredited Specialist in Commercial Litigation recognised by both the Queensland Law Society and the Law Institute of Victoria.
I have been a Nationally Accredited Mediator with the Resolution Institute since 2008.
I am also a committee member of the Resolution Institutes' Special Interest Group for Mediation in Victoria assisting with the education and development of mediation in that State and also sit on the ACCC's Consultative Committee for Small Business and Franchising.
Specialist experience and qualifications
As a legal practitioner I have advised and acted for clients in relation to intellectual property disputes particularly focusing on trademarks, patents and copy right together with related claims of passing off, misleading and deceptive conduct and breach of contract.
This includes acting for pharmaceutical developers, manufacturers of therapeutic products, franchise systems with registered marks, small businesses threatened with infringement action for pre-existing businesses, individuals asserting theft or misappropriation of intellectual property.
I have appeared on behalf of clients in the Supreme Courts of Queensland and Victoria and the Federal Court in respect of intellectual property matters and until recently a frequent attendee at IPSANZ events in Brisbane, Queensland until my relocation to Melbourne, Victoria.
I have mediated matters involving disputes such as trade marks, patents and copyright together with related claims of passing off, misleading and deceptive conduct and breach of contract, with the majority of these mediations involving legally represented parties.
An average mediation takes between 6-8 hours of mediation time and approximately 2-3 hours of pre-mediation preparation which includes a pre-mediation meeting with the respective parties ranging between 45-1 hour in length.
Approximately 85% of matters referred to me for mediation resolve through the parties mutual agreement at the mediation.
Feedback received from participants and their legal advisers in mediations conducted by me has been positive about the manner in which the process is conducted and their understanding and participation in the mediation.
I am available to assist mediate matters in both Queensland and Victoria with no travel cost passed on to the parties for doing so.
