Trade Mark Protect is designed to assist small and medium enterprises by providing a sustainable and affordable option for trade mark applicants and owners to meet the costs of defending their trade mark against an opposition to registration or application for removal of their trade mark.

What does it cover?

There are two types of cover:

  • Pre-registration – this is intended to provide cover during the opposition process only.
  • Post-registration – this is intended to provide cover post registration and the insured is required to renew the policy every 12 months.

The insurance product has been designed to cover all types of trade marks accepted or registered in Australia.

The product is only available for use within Australia, but can be purchased and taken out by those filing from overseas into Australia.  

Trade Mark Protect does not protect customers in enforcing their trade mark.
