Issue summary: 

A trading or business name does not have legal personality. Neither does the name of a trust. However, unrepresented applicants who file trade mark applications often file their application in the name of a business or a trust.

Changes to IP Australia's e-Services and PDF application forms will provide more guidance for applicants on what does and does not constitute a correct applicant name.

High priority, as this is a relatively straightforward implementation that will improve IP Australia's customers' experience.

eServices and form amendments are expected to be rolled out in 2018. No legislative change is required.
