To be eligible for ongoing employment, applicants must be Australian Citizens. However, applicants who have permanent residence status may be offered probationary employment pending the granting of citizenship.

The Occupational Health and Safety Act 1991 requires IP Australia to protect employees and contractors from workplace hazards, including potentially harmful air contaminants. In order for IP Australia to meet these obligations, the agency will be implementing a Smoke Free Work Environment Policy which will come into effect on 2 January 2007. The Policy will require employees to abstain from smoking during working hours, while representing IP Australia, while traveling on official duty, or within 15 metres of any part of IP Australia occupied buildings.
