Trade mark fees

Trade mark registration and renewal fees can now be paid online.

The following information is based on a typical, successful application. There are a number of other fees that apply to other actions that may be required on your trade mark application. A full list of these fees and the methods of payment are available online. Alternatively, contact IP Australia on 1300 651010.

Application to register on-line using the official Goods & Services pick-list $120 per class
Application to register on-line not using the official Goods & Services pick-list $160 per class
Application to register a series* of trade marks on-line using the official Goods & Services pick-list
$270 per class
Application to register a series* of trade marks on-line not using the official Goods & Services pick-list $310 per class

Filing a paper application form

Application to register $180 per class
Application to register a series* of trade marks $330 per class

The reduced fee only applies when filing online using the official online form.

TM Headstart Entry Fee $90 per class
TM Headstart Part 2 Fee $90 per class

The entry fee is payable when you submit your TM Headstart request. The Part 2 fee is payable only if you decide to complete the filing process. The Part 2 fee is only payable online or over the telephone with an IP Australia staff member during business hours.

Registration fees (payable within 6 months of acceptance)

Registration occurs after your trade mark has been examined, accepted for registration and has passed through any opposition.

Registration $250 per class
Fees for a renewal due on or after 1 September 2002 $300 per class

Classes of goods and service

Example of fees payable when filing and registering in more than 1 class:

If, for example, you want to apply to register a trade mark for perfume, clothing and sunglasses-perfume is in class 3, sunglasses are in class 9 and clothing is in class 25.

You would file a multi-class application covering classes 3, 9 and 25, so the fee you have to pay at filing is $540-[$180 x 3] or $360 when filing on-line - OR [$120 x 3] when applying on-line using the official Goods & Services pick-list.

If your trade mark gains registration, you will have a registration fee to pay after your trade mark is accepted. This would be $750 on current costs-[$250 x 3].

These fees are subject to change. Under the Trade Mark Act the fees payable are those in place on the day on which payment is made.

The Trade Marks Act has various fees which are required to be paid. If you choose to pursue trade marks activities without professional advice, you should take care to understand the requirements, the related fees and associated time frames. Failure to meet the deadlines or pay a fee on time can have serious consequences for your application.
