Trade Marks

How long will it take?

Applications filed two and half months ago are now being examined. This waiting period is now decreasing. If you file a trade mark application today, it is likely to be examined within three months or less.

Remember that, if granted, rights from registration of a trade mark accrue from the date of filing.

If you believe that you will be seriously disadvantaged because of the time taken between filing and examination you may request that your application be examined sooner. There are no fees associated with lodging an application to expedite however it must be accompanied by a witnessed declaration detailing the reasons for your request.

Please address any further enquiries to the IP Australia Customer Services Network on 1300 651 010 or email assist@ipaustralia.gov.au.
