Update 8 October 2025
The Commissioner of Patents is working to make the necessary updates this month to the Patent Manual of Practice and Procedure (the Manual) following this decision.
All material changes to the Manual are subject to our governance processes. Opportunities for feedback will be provided. In the meantime, customers with questions about the examination of computer-implemented inventions are encouraged to contact Supervising Examiners of the relevant technology areas.

Original statement 16 September 2025
On 16 September 2025, the Full Federal Court ruled in favour of Aristocrat in the matter of Aristocrat Technologies Australia Pty Ltd v Commissioner of Patents [2025] FCA 131.
The Full Federal Court found that all claims remitted for consideration following the previous Full Federal Court and High Court decisions are for a manner of manufacture and therefore are patentable subject matter.
