Issue summary

Currently anyone can file, progress and maintain a trade mark in Australia. Concerns have been raised that this situation may lead to negative outcomes for trade mark applicants, particularly those using non-resident agents who may be unfamiliar with Australian laws and practice. Registered trade mark attorneys are seeking clarity on who should be able to assist applicants and owners with their trade marks. IP Australia welcomes any feedback on this issue, including evidence demonstrating a problem.
