We will send you an International Search Report (ISR) and a written opinion.
The ISR and written opinion are usually issued within three months of the PCT application being filed or nine months from the earliest priority date, whichever is later.
The written opinion can assist you in refining your patent strategy. It examines your application based on:
- novelty: is it new?
- industrial applicability: is it useful or practical?
- the presence of an inventive step: is the difference between what is known and your invention an obvious step?
You can choose to amend your claims based on the findings of these reports. If you choose not to amend your application, the ISR and written opinion are published as the international preliminary report on patentability (IPRPI).
Amendments to the claims must be made within two months of receiving the reports or within 16 months of the earliest priority date, whichever is later. You must send your amended claims, together with the reasons you are making them, to the International Bureau. This can be done using the document upload in ePCT.
There is no additional fee for the reports. They are covered by the application fee.
Length of reporting process
Reports are generally sent to you within three months of the filing date.
