Issue summary

Currently, applicants for registration of trade marks or registration of designs who claim priority from their filings abroad can be required to provide copies of their foreign applications certified by the foreign IP offices. These priority documents must be copies on paper because the trade marks and designs legislation doesn't allow the electronic interchange of trade marks and designs documents between IP Australia and other IP offices. The World Intellectual Property Organization's Digital Access Service (DAS) has been available to patent applicants as a means of providing patents priority documents since December 2009. The DAS could be extended to trade marks and designs priority documents.

IP Australia considered this issue, upon further analysis it has been determined that no legislative change is required for IP Australia to participate in DAS for trade mark and designs.
