IP Australia has updated the Trade Marks Manual of Practice and Procedure with a new chapter on revocation of acceptance, revocation of registration and amendment of cessation of protection.
Content in the 'Revocation of Acceptance' and 'Revocation of Registration' chapters has been consolidated into a single chapter, New Part 36: Revocation of Acceptance, Revocation of Registration and Amendment of Cessation of Protection, making it easier for users to find and navigate revocation and amendment or cessation of protection-related guidance in one location.
Guidance has also been added based on the decision of the Full Bench of the Federal Court in Registrar of Trade Marks v National Cancer Foundation Limited [2026] FCAFC 95.
Please note that this chapter replaces previous Parts 38 and 62. IP Australia welcomes feedback on the Manual via email to the Quality, Practice and Customers Team (QPC) at MDB-TechnicalHub@ipaustralia.gov.au.
