IP First Response

IP First Response is a pilot resource developed by IPAVentures to help individuals and businesses understand how to address potential intellectual property (IP) infringement concerns. It provides a simple entry point to information about:

  • addressing suspected infringement
  • responding to an accusation of infringement
  • strategies to avoid future IP issues
  • understanding how the Australian IP system works, specifically for small and medium enterprises (SMEs).

IP First Response doesn’t replace professional advice. It helps users understand the options available and what to consider before deciding on a course of action.

During its initial phase, the tool focused on patents and trade marks. Designs rights, plant breeder’s rights, and copyright have been introduced while user feedback continues to help refine the tool and shape further enhancements.

Why are we doing it?

Traditionally, IP enforcement has been the responsibility of IP owners. However, IPAVentures recognise that many SMEs and individual rights holders find it difficult to navigate enforcement pathways.

Through early research and stakeholder engagement, IPAVentures identified that:

  • limited visibility of enforcement options reduces the value of owning IP rights
  • resource imbalances can disadvantage smaller businesses or individuals in enforcing their IP rights
  • limited information on negotiation or alternative resolution methods can leave many unsure of next steps.

IP First Response aims to address these challenges by making IP enforcement more accessible and understandable – without replacing professional advice.

What are we doing?

At the heart of this pilot is a navigation tool that allows users to explore potential enforcement pathways based on what might be relevant to similar businesses.

IP First Response is currently in beta. It allows customers to explore information about IP protection and enforcement across 4 key areas:

  • I believe my IP has been infringed
  • I’ve been accused of IP infringement
  • I want to prevent IP issues
  • I want to understand how IP works.

IP First Response presents information that is most likely to be relevant to your situation, including general timeframes, costs and potential outcomes.

Collaboration is central to this pilot. We’re working with relevant government agencies, industry bodies, and professional networks to make sure we reach key audiences and gather insights to improve the service.

What have we learned so far?

Testing and research over several months have highlighted key insights:

  • Transparency of information
    Users value clear, step-by-step explanations about why certain enforcement options may be relevant to them.
  • Avoiding overwhelm
    Too much detail at once can confuse users. Content needs to be introduced gradually and in an organised way.
  • User-friendly language
    Even experienced IP rights holders can find legal terms and jargon challenging. Using clear, plain English remains essential.
