Issue summary

Currently, the fees IP Australia charges are contained in schedules of the trade mark, patents, designs and PBR Regulations. Changes could be made to the IP Rights legislation to empower the Commissioner and Registrar to determine the fees IP Australia charges in non-legislative instruments. This could give greater flexibility for IP Australia to amend fees to take account of changing operational circumstances.

Any fee changes would still be consulted on publicly, and fees would continue to be set in accordance with the Australian Government’s Cost Recovery Guidelines.
