Issue summary

In its 2010 review of PBR enforcement, the Advisory Council on Intellectual Property (ACIP) recommended (recommendation 12) that an on-going Expert Panel be established to provide guidance and opinions on general issues or specific cases concerning the PBR Act and related law.

The government response at the time was to accept in principle the recommendation, noting that the Plant Breeder's Rights Advisory Committee (PBRAC) was able to perform the functions of the Expert Panel as recommended by ACIP.

A PBR consultation group now exists. Consideration should be given as to whether this group could perform the functions of an expert panel.
